Einen öffentlichen Notar nennt man in den USA "notary public"!
Öffentliche Notare unterstehen dem "Secretary of State's office" des jeweiligen Bundesstaates!
unter dem Link "handbook" bei den jeweiligen "Secretaries of State" findet man immer die Notariatsverordnung des jeweiligen Bundesstatates!!

64-105.03 Notary Public; unauthorized practice of law; prohibited.
1) A Notary Public who is not an attorney shall not engage in the unauthorized practice of law as provided in this section.
2) If notaries’ certificate wording is not provided or indicated for a document, a Notary Public who is not an attorney shall not determine the type of Notarial act or certificate to be used.
3) A Notary Public who is not an attorney shall not assist another person in drafting, completing, selecting, or understanding a document or transaction requiring a Notarial act.
4) A Notary Public who is not an attorney shall not claim to have powers, qualifications, rights, or privileges that the office of Notary Public does not provide, including the power to counsel on immigration matters.
5) A Notary Public who is not an attorney and who advertises Notarial services in a language other than English shall include in any advertisement, notice, letterhead, or sign a statement prominently displayed in the same language as follows: "I am not an attorney and have no authority to give advice on immigration or other legal matters".
6) A Notary Public who is not an attorney may not use the term notario publico or any equivalent non-English term in any business card, advertisement, notice, or sign.
7) This section does not preclude a Notary Public who is duly qualified, trained, or experienced in a particular industry or professional field from selecting, drafting, completing, or advising on a document or certificate related to a matter within that industry or field.
8) A violation of any of the provisions of this section shall be considered the unauthorized practice of law and subject to the penalties provided in section 7-101.

Wie wird man Notar in Kalifornien - es gelten folgende Bedingungen, um ein öffentlicher Notar in Kalifornien zu werden:

GENERAL INFORMATION 7
APPOINTMENT AND QUALIFICATIONS
In order to qualify to become a notary public you must meet all of the following requirements:
(Government Code section 8201)
• Be a legal resident of the State of California;
• Be at least 18 years of age;
• Satisfactorily complete a course of study approved by the Secretary of State;
• Pass a written examination prescribed by the Secretary of State; and
• Pass a background check.
To determine if a person meets the requirements to fulfi ll the responsibilities of the position, a completed application and a 2” x 2” color passport photograph of the applicant shall be submitted at the examination site, then forwarded to the Offi ce of the Secretary of State andreviewed by Secretary of State staff for qualifying information. (Government Code section 8201.5)
To assist the Secretary of State in determining the identity of an applicant and whether theapplicant has been convicted of a disqualifying crime, state law requires all applicants to be fi ngerprinted as part of a thorough background check prior to being granted an appointment as a notary public. (Government Code section 8201.1) Information concerning the fi ngerprinting requirements will be mailed to candidates who pass the examination.
